What Is the SH 68 Project?

TxDOT's Pharr District is building a new 22-mile State Highway 68 corridor in Hidalgo County, connecting I-2/US 83 in the south to I-69C/US 281 in the north. This is a brand-new alignment — TxDOT must acquire right-of-way from private landowners across the entire route.

What Their Offer May Miss

The agency's appraisers work for the agency — not for you. Their initial offer routinely omits significant categories of compensation you may be entitled to under Texas law.

Remainder Tract Damage

When TxDOT takes a portion of your land, the value of what's left behind may drop significantly. You're entitled to compensation for that loss.

Crop & Agricultural Income

Farmland and ranchland in Hidalgo County has active agricultural value. TxDOT's appraisal may undervalue or entirely miss lost crop income.

Access & Frontage Loss

If the taking cuts off your road frontage, access to an irrigation canal, or access to portions of your tract, that's a compensable damage.

Irrigation Infrastructure

Irrigation lines, pumps, and water rights serving affected parcels may require relocation or may be permanently lost — these have real value.

Business Damages

If you operate a business on or near the affected property, certain types of business losses may be compensable depending on the circumstances.

Improvements & Structures

Fences, outbuildings, gates, landscaping, and other improvements in the take area must be valued accurately in your compensation.

Frequently Asked Questions

Can I negotiate with TxDOT on the SH 68 project?

Yes. TxDOT is required to make a good-faith offer, but that offer is negotiable. You have the right to present your own appraisal and demand a higher amount. If TxDOT won't agree, they must file a condemnation suit and a court or jury determines compensation.

TxDOT said their offer is based on an independent appraisal. Is that true?

TxDOT does hire appraisers — but those appraisers work for TxDOT. An appraisal commissioned by TxDOT is not the same as an appraisal that advocates for your maximum value. You are entitled to hire your own appraiser.
